Terms and Conditions

Nammude Radio provides online radio streaming, music and audio programming, local and community-oriented content, mobile application functionality, account features, interactive experiences, promotional activities, reward features, and other related services.

The availability, design, programming, schedules, hosts, stations, streams, features, rewards, and functionality of the Services may change over time. We may add, modify, suspend, or discontinue any feature or portion of the Services where reasonably necessary for operational, legal, licensing, security, technical, or business reasons.

Internet access and compatible hardware or software may be required to use the Services. You are responsible for charges imposed by your internet, mobile, or other service providers.

Certain features may require you to create an account or verify a mobile telephone number. You agree to provide information that is accurate and reasonably complete and to keep account information current when necessary.

You are responsible for protecting passwords, one-time passcodes, authentication codes, and other credentials associated with your account. You should not disclose authentication codes to another person. If you believe an account has been compromised or used without authorization, contact us promptly.

We may use reasonable security measures to verify identity, prevent fraud, enforce eligibility restrictions, protect reward balances, or investigate suspicious activity. We may temporarily restrict access to an account when reasonably necessary to protect users or the Services.

Nammude Radio may send SMS messages for account authentication and verification. These messages may include one-time passcodes or security codes requested during account registration, sign-in, phone-number verification, account recovery, or another account-security process.

Users initiate these messages by entering a mobile telephone number and requesting a verification code. The authentication SMS program is intended for transactional account-security messages and is not a marketing, advertising, or fundraising messaging program.

You may reply STOP to opt out of SMS messages and HELP for assistance. After you opt out, we may send a confirmation message and will stop sending messages covered by that opt-out unless you later take an appropriate step to re-enable messaging or provide renewed consent.

If you opt out of authentication texts, features that require SMS verification may become unavailable until SMS messaging is re-enabled or an alternative verification method is offered.

Our handling of mobile information and SMS consent is described in our Privacy Policy. Mobile information and text-messaging originator opt-in data and consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

Nammude Radio may stream or provide access to music, talk programming, interviews, news, community content, artwork, metadata, advertisements, sponsorship material, and other media. Some content may be owned or licensed by third parties.

Your access to content through the Services is for personal, non-commercial use unless we expressly authorize otherwise. You may not copy, record, rebroadcast, publicly perform, redistribute, sell, scrape, or otherwise exploit streamed or licensed content except as permitted by applicable law or with the appropriate rights holder's permission.

Programming schedules, song availability, hosts, interviews, streams, and other content may change without notice. We do not guarantee that any specific song, program, host, guest, or stream will be available at a particular time.

Nammude Radio may offer interactive activities, daily engagement features, quizzes, guesses, predictions, streaks, points, coins, promotional rewards, gift cards, coupons, or similar programs. Unless otherwise stated in specific program rules, these features are provided for entertainment and promotional purposes.

NR Coins and similar points

NR Coins or other points issued through the Services are promotional loyalty units and are not money, cryptocurrency, stored value, or property. They have no cash value except to the extent Nammude Radio expressly permits redemption for a particular reward under the applicable program rules. They cannot be transferred, sold, assigned, pledged, or exchanged outside the Services unless we expressly authorize such activity.

We may establish earning limits, expiration rules, redemption thresholds, activity values, reward values, availability limits, or other program conditions. These conditions may change prospectively as the program evolves, subject to applicable law.

Activities and promotional games

Activities such as quizzes, guessing games, prediction activities, lucky-box features, mystery pictures, or similar experiences may have additional instructions or rules displayed within the application. Unless expressly stated otherwise, no purchase is necessary to participate, participants do not wager money or items of value, and outcomes do not create an entitlement to cash.

We may disqualify activity results reasonably determined to involve automated participation, account manipulation, duplicate accounts, fraud, technical exploitation, abuse, or violation of applicable program rules.

Gift cards, coupons, and third-party rewards

Some rewards may be issued, fulfilled, or administered by third parties. Third-party gift cards, vouchers, coupons, or similar rewards are subject to the issuer's own terms, restrictions, expiration rules, availability, and redemption policies. Nammude Radio does not control the independent terms imposed by a third-party issuer.

Rewards may be unavailable, substituted with a reasonably comparable reward, or delayed where necessary due to inventory, fulfillment, fraud review, service interruptions, or third-party limitations.

You agree not to misuse the Services. Prohibited conduct includes, without limitation:

• attempting to gain unauthorized access to accounts, systems, APIs, servers, or data;
• using bots, scripts, automation, emulators, or other techniques to manipulate activities, rewards, listening metrics, account verification, or eligibility;
• creating fraudulent, misleading, duplicate, or impersonating accounts;
• circumventing security controls, rate limits, geographic restrictions, eligibility rules, or program restrictions;
• introducing malware or interfering with the availability or operation of the Services;
• harassing, threatening, defaming, or unlawfully targeting another person;
• using the Services for unlawful, fraudulent, deceptive, infringing, or abusive purposes; or
• using Nammude Radio content or branding in a manner that falsely suggests sponsorship, endorsement, or affiliation.

We may investigate suspected violations and take reasonable measures to protect the Services, including limiting features, withholding fraudulently obtained rewards, suspending accounts, or terminating access where appropriate.

If the Services allow you to submit messages, feedback, contest entries, images, audio, suggestions, or other content, you remain responsible for the content you submit and must have the rights necessary to submit it.

You grant Nammude Radio a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use submitted content solely to operate, provide, moderate, promote, or improve the applicable feature, unless a separate set of rules states otherwise.

Feedback, ideas, or suggestions about the Services may be used by us without restriction or compensation, provided that we do not publicly identify you as the source without permission unless permitted by law.

The Nammude Radio name, logos, software, interfaces, designs, graphics, original text, original programming, and other materials created by or for Nammude Radio are owned by Head Heart and Hand Foundation Inc or its licensors and are protected by applicable intellectual-property laws.

Third-party music, recordings, artwork, trademarks, program material, and other licensed content remain the property of their respective owners. Nothing in these Terms transfers ownership of intellectual property to you.

The Services may integrate with or link to third-party platforms, app stores, streaming providers, reward issuers, websites, social networks, analytics providers, telecommunications providers, or other services. Those services are controlled by their respective operators and may be subject to separate terms and privacy policies.

Nammude Radio is not responsible for the independent content, availability, security, policies, or practices of third-party services. A link or integration does not necessarily mean that Nammude Radio endorses the third party.

We work to provide reliable Services, but availability can be affected by maintenance, internet connectivity, mobile carriers, app stores, third-party providers, licensing limitations, technical failures, security incidents, or events outside our reasonable control.

We do not guarantee uninterrupted, error-free, or continuous operation. We may perform maintenance or make changes to improve security, reliability, functionality, or compliance.

You may stop using the Services at any time. We may suspend or terminate access to all or part of the Services if we reasonably believe an account or user has violated these Terms, created security or legal risk, engaged in fraud or abuse, or if suspension is otherwise reasonably necessary to protect the Services or other users.

Upon termination, provisions that by their nature should survive will continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, dispute provisions, and accrued rights or obligations.

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will always be uninterrupted, secure, error-free, or available, or that all content, streams, messages, notifications, verification codes, rewards, or third-party services will be delivered or available without delay.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Head Heart and Hand Foundation Inc, Nammude Radio, and their directors, officers, employees, volunteers, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of or inability to use the Services.

Where applicable law does not permit a particular limitation or exclusion of liability, that limitation or exclusion will apply only to the extent permitted by law. These Terms do not limit liability that cannot legally be limited.

To the extent permitted by law, you agree to indemnify and hold harmless Head Heart and Hand Foundation Inc and its directors, officers, employees, volunteers, and agents from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, your material violation of these Terms, or your infringement of another party's rights.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that another jurisdiction's laws must apply as a matter of law.

Nothing in this section limits rights or remedies that applicable consumer-protection law does not permit you to waive.

We may update these Terms from time to time to reflect changes in the Services, features, law, technology, or our operational practices. The “Last updated” date at the top of this page identifies the most recent version.

Where required by law or appropriate based on the significance of a change, we may provide additional notice. Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure by Nammude Radio to enforce a provision is not a waiver of the right to enforce it later.

These Terms, together with the Privacy Policy and any additional rules presented for a specific promotion, activity, or feature, constitute the applicable agreement between you and Nammude Radio regarding the Services covered by those documents.
